Terms of Service

Welcome to Kairox ("Kairox," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the Kairox mobile application, subscriptions, content, features, and related services (collectively, the "Service").

By downloading, accessing, or using Kairox, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Eligibility

You must be at least 13 years old to use Kairox. If you are under the age required by the laws of your jurisdiction to consent to digital services, you may use the Service only with the permission of a parent or legal guardian.

By using the Service, you represent that you meet the eligibility requirements, the information you provide is accurate, and you will comply with these Terms and applicable law.

Description of the Service

Kairox is a digital wellness and screen time application designed to help users reduce distracting social media use by requiring physical movement before selected apps can be accessed.

Features may include social media app blocking, exercise-based unlocking, push-up, squat, and lunge tracking, earned social media minutes, app restriction management, screen time insights, streaks, achievements, notifications, Apple Family Controls integration, Apple Screen Time integration, and premium subscription features.

The Service is intended for productivity, habit-building, and general movement encouragement only. It does not provide medical, fitness, psychological, or healthcare advice.

Account Registration

Certain features may require an account created through Apple Sign In, Google Sign In, phone authentication, or another supported method.

You are responsible for maintaining account security, protecting login credentials, all activity under your account, and providing accurate information. You may not impersonate another person, use false information, create accounts for unlawful purposes, or sell, transfer, or share your account.

We may suspend or terminate accounts that violate these Terms.

Exercise Detection and Camera Permissions

Kairox may use your device camera during an active exercise session to recognize supported movements, count completed repetitions, and calculate earned social media minutes.

By granting camera access, you authorize Kairox to use the camera for these features. Camera permission may be revoked at any time through your device settings, but doing so may prevent exercise-counting features from working.

Exercise and Health Disclaimer

You are responsible for determining whether an exercise is appropriate for your health, ability, fitness level, space, and surroundings. Use proper form, keep your exercise area clear, and stop immediately if you experience pain, dizziness, weakness, shortness of breath beyond normal exertion, or unusual discomfort.

Kairox is not responsible for injuries or health issues arising from exercise performed while using the Service, except where liability cannot legally be excluded.

Family Controls and Device Permissions

Kairox uses Apple’s Family Controls, Screen Time, Managed Settings, and related frameworks to manage restrictions for applications selected by the user.

By granting the required permissions, you authorize Kairox to restrict selected applications, manage earned unlock sessions, apply app blocking rules, track unlock availability, and store restriction preferences.

Kairox does not access private messages, photos, emails, passwords, or content stored inside other applications. Permissions may be revoked through your device settings, but doing so may disable app blocking.

Notifications

By enabling notifications, you agree that Kairox may send exercise reminders, earned-minute alerts, unlock expiration alerts, streak updates, achievement notifications, product announcements, and subscription-related notifications.

You may disable notifications at any time through your device settings.

Subscription Terms

Certain Kairox features require an active paid subscription. Kairox offers a monthly subscription and a yearly subscription with a 3-day free trial.

Payments are processed by Apple through the App Store. Monthly subscriptions are charged monthly and automatically renew unless canceled. Yearly subscriptions include a 3-day free trial and, unless canceled before the trial ends, the full yearly subscription price will be charged automatically.

Subscriptions renew automatically unless canceled through your Apple ID subscription settings before the applicable renewal date. Billing, refunds, and subscription management are handled under Apple’s policies. Subscription pricing may change where permitted by law and with any notice required by law.

Deleting Kairox does not cancel an active subscription.

Acceptable Use

You agree not to reverse engineer or modify the Service, attempt unauthorized access, interfere with servers or systems, circumvent restrictions or subscription systems, exploit bugs or vulnerabilities, misuse permissions, distribute malicious code, scrape the Service, or use Kairox for an unlawful purpose.

We may investigate misuse and take appropriate action, including suspending or terminating access.

Intellectual Property

All Kairox branding, logos, app designs, graphics, animations, user interface elements, software, features, text, and other Service content are owned by Kairox or its licensors and are protected by intellectual property laws.

You may not copy, reproduce, modify, distribute, or commercially exploit any part of the Service without prior written permission.

Data and Privacy

Your use of Kairox is also governed by our Privacy Policy. By using the Service, you acknowledge that information may be collected and processed as described there.

Service Availability

We may modify, suspend, or discontinue all or part of the Service at any time. App blocking and exercise detection may depend on device permissions, Apple frameworks, operating-system behavior, hardware, lighting, camera positioning, network availability, and user settings.

We do not guarantee continuous availability, error-free operation, perfect repetition detection, data preservation, or compatibility with every device or operating-system version.

Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAIROX DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND AVAILABILITY.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAIROX SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, LOST PROFITS, LOSS OF DATA, DEVICE DAMAGE, OR PERSONAL INJURY ARISING FROM USE OF THE SERVICE.

If liability cannot be excluded, Kairox’s total liability shall not exceed the amount you paid for the Service during the twelve months preceding the claim.

Indemnification

You agree to defend, indemnify, and hold harmless Kairox and its affiliates, officers, employees, and licensors from claims, damages, liabilities, losses, and expenses arising from your use of the Service, violation of these Terms, violation of applicable law, or infringement of third-party rights.

Termination

We may suspend or terminate access if you violate these Terms, misuse the Service, if required by law, or when necessary to protect users, Kairox, or the Service. You may stop using Kairox at any time.

Provisions concerning intellectual property, disclaimers, limitations of liability, indemnification, and governing law survive termination.

Governing Law

These Terms are governed by the laws of the United States and applicable state law, without regard to conflict-of-law principles.

Changes to These Terms

We may revise these Terms from time to time. When changes are made, the Effective Date above will be updated. Continued use of Kairox after updated Terms become effective constitutes acceptance of the revised Terms.
